Central Avenue Corridor Improvements

ADVERTISEMENT AND NOTICE TO BIDDERS

Notice is hereby given that sealed proposals (“Bids”) will be received by the City of Union City (“City”) for the "CENTRAL AVENUE CORRIDOR IMPROVEMENTS" (“Project”) and publicly opened and read aloud at the City of Union City, City Hall, 3715 Palisade Avenue, Union City, New Jersey 07087, in the Office of the City Clerk, on Tuesday, March 29, 2022 at 11:00 a.m., prevailing local time.  IT IS RECOMMENDED THAT BIDS BE PRESENTED BY THE BIDDER OR AN AUTHORIZED REPRESENTATIVE AT THE ABOVE STATED DATE AND TIME.  BIDS NOT RECEIVED BY THE DATE AND TIME OF THE BID OPENING WILL BE REJECTED.

The Project generally consists of the resurfacing and reconstruction of Central Avenue, from 21st Street to 30th Street and from 31st Street to 35th Street, as delineated on the contract drawings, including but not limited to Hot Mix Asphalt milling and/ or full depth pavement repairs, installation of new concrete curbs, scored concrete and granite block sidewalks, ADA compliant curb ramps, scored concrete and granite block driveways, installation of lighting foundations, decorative bollards, shade trees, semi-circular granite block tree wells, square tree wells with ADA compliant tree grates, speed humps, painting various existing features, reset junction box frames and covers, reset window well grates, replacement of cellar doors, upgrading inlets with bicycle safe grates and eco curb pieces, installation of 3” thick Hot Mix Asphalt 9.5M64 Surface Course and 4” thick Hot Mix Asphalt 19M64 Base Course, and related work within the City of Union City, and all other associated work as contained in the Contract Documents or as ordered by the Engineer.

The Apparent Lowest Responsive and Responsible Bidder (“Contractor”) awarded a contract must begin construction as soon as possible and all work on this contract must be substantially complete within 90 calendar days after the date when the contract time commences to run.

Specifications and Contract Documents and Contract Drawings (“Contract Documents”) for the proposed work prepared by David J. Samuel, P.E., Consulting Engineer, CME Associates (“CME”), may be examined at the office of said engineer at 3141 Bordentown Avenue, Parlin, New Jersey 08859, and at the office of the City Clerk, 3715 Palisade Avenue, Union City, New Jersey 07087, during business hours beginning on Wednesday, March 16, 2022.  The Contract Documents will not be available for pickup.  The Contract Documents are available electronically or via delivery by common carrier until forty-eight (48) hours prior to the time set for the opening of bids by making an e-mail request and registering as a Prospective Bidder (“Bidder”) for the project to BRyan@cmeusa1.com.  The e-mail request and registration shall include, but not be limited to the following Bidder’s Information:  Company’s Name, Company’s Physical Address, Company’s Mailing address (if different than the Physical Address), Company’s Phone Number, Company’s Fax Number, Company’s E-mail Address, and Company’s Contact Name for the Individual that should be sent information with regard to Project clarifications and/or addenda, if any, prior to the bid opening.

Bidders will be furnished with a copy of the Contract Documents by request upon proper notice to the above e-mail address.  In the e-mail message, the Bidder shall indicate if they request an electronic copy (PDF format) or paper copy.  Electronic copies will be provided via an FTP site maintained by CME at no charge.  Bidders will be provided with a login and password to download the Contact Documents.  You must first register with CME to be eligible to receive a login and password.  CME will ensure that the site works, however CME will not be responsible if the Bidder cannot download the Contract Documents.  Paper copies will be provided only after a non-refundable payment of $100.00 (payable to CME Associates) per set of Contract Documents is received.  Paper copies will only be sent via UPS or FedEx if the Bidder provides their UPS or FedEx account information to defray the cost of this shipping method.  Otherwise, paper copies will be sent via USPS.  The City and CME will not be held responsible for any document(s) sent by UPS, FedEx, or USPS that may become lost, damaged, or not received in time.

NO BIDS MAY BE SUBMITTED ELECTRONICALLY.  Section C, Proposal, of the Contract Documents shall be submitted in sealed envelopes addressed to the City Clerk of Union City, the envelope shall have marked conspicuously on its face on the top right-hand side in letters not less than one inch the word “Public Bid” followed immediately below those words in letters not less than one-half inch high: “Central Avenue Corridor Improvements” and underneath that “To be received on Tuesday, March 29, 2022 at 11:00 a.m”.  Contractor must submit within the same sealed bid envelope – 1 original proposal package and 2 complete copies of the bid package.

If Bids are to be accepted by mail or courier, the Bids must be placed in an outer envelope, which on the top right-hand side shall clearly designate in the same manner as set forth above, the same size and information.  The inner envelope shall have specifically placed in the center the same information as set forth above and on the bottom left-hand side the name and address of the Bidder.

All Bids delivered by mail or other postal service shall be addressed specifically to the City Clerk of Union City and if delivered by a postal service shall be delivered to the office of the City Clerk, 3715 Palisade Avenue, Union City, New Jersey, 07087 between the hours of 9:00 a.m. and 4:00 p.m. prior to the time set forth for the opening of the Bid and not earlier than forty-eight (48) hours prior to the opening of the Bid.

Each Bid must be accompanied by a certified check or cashier’s check in the amount of not less than ten (10%) percent of the Bid, but not more than $20,000.00, payable without any conditional endorsement as a guarantee that in case the contract is awarded to the Contractor, he will within ten (10) days thereafter execute such contract and furnish satisfactory performance bond.  Upon failure to do so he shall forfeit the deposit as liquidated damages and the acceptance of the bid will be contingent upon the fulfillment of this requirement by the Contractor.  No interest shall be allowed upon any such certified check or cashier’s check.  A bid bond in the amount of ten (10%) percent of the bid, but not more than $20,000.00, may be substituted for certified check or cashier’s check. The bidder shall be required to comply with the requirements of N.J.S.A. 40A:11-21 and N.J.S.A. 40A:11-22.  In addition, a Certificate (Consent of Surety) with Power of Attorney for full amount of bid price from a Surety Company authorized to do business in the State of New Jersey and that said Surety will furnish a Performance Bond, and Labor and Materials Payment Bond for the full amount of the bid, in accordance with the bid specifications.

The City reserves the right to increase or decrease quantities specified in the manner designated in the Specifications.  The City reserves the right to award this contract based on funds available and same will not be made until the necessary funds have been provided by the City in a lawful manner.

All Bidders are required to be registered with the New Jersey Department of Labor if they elect to bid public works projects.  The Bidder shall be required to comply with “The Public Works Contractor Registration Act” (N.J.S.A. 34:11-56.48), as identified in Section B – Instruction to Bidders paragraph B3.13 and in the Appendix of the Specifications and Contract Documents.  All Contractors and Subcontractors working on prevailing wage projects, which have a public building component, must attach a certificate of registration from the Department of Labor, to all bids.

All Bidders are required to submit “Proof of Business Registration” to the contracting agency if they elect to bid public works projects.  Proof of business registration shall be a copy of a Business Registration Certificate issued by the Department of the Treasury, Division of Revenue.  The Bidder shall be required to comply with business registration provisions of N.J.S.A. 52:33-44 (P.L. 2004, C.57), as identified in Section B-Instruction to Bidders paragraph B3.14 and in the Appendix of the Specifications and Contract Documents.  All Contractors and Subcontractors working on public work projects must attach a Business Registration Certificate to all bids.

Bidders will be required to comply with the public disclosure provisions of N.J.S.A. 52:25-24.2.

The Apparent Lowest Responsive and Responsible Bidder (“Contractor”) shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the laws of 1963, effective January 1, 1964.

During the performance of this Contract, the Contractor agrees to comply with the requirements of P.L. 1975, c.127 (N.J.A.C. 17:27), and N.J.S.A. 10:5-31 et seq., all requirements of the State of New Jersey Worker Health and Safety Act (N.J.A.C. 12:110 et seq.) as amended and the United States Occupational Safety and Health Act (OSHA) (29 CFR 1910), as amended with regard to worker and jobsite safety.

No Bidder may withdraw his bid for a period of sixty (60) days after the date set for the opening thereof.  The Contractor will be required to furnish a surety company bond in the full amount of contract price indemnifying the City of Union City, New Jersey, for all proceedings, suits or actions of any kind of description and conditional for the faithful performance of the work.

All bid security will be returned to all Bidders except the three (3) apparent lowest bidders within ten (10) working days after the opening of bids, and to the three (3) apparent lowest Bidders within three (3) working days after the successful Bidder has executed the Contract and his Contract security has been approved by the City.

The award shall be subject to the approval of the New Jersey Department of Transportation.

Bidders are advised that the capital improvements are partially funded by the State of New Jersey, 1984 Transportation Trust Fund Authority Act, and the successful bidder will be required to fully comply with the applicable current "New Jersey Department of Transportation Standard Specifications for Road and Bridge Construction" if, and as amended or supplemented by the NJDOT Local Aid District Office.

The City reserves the right to reject any or all bids if in its opinion it is in the best interest to do so and to award the contract for any and/or all items.
